Representation of Debtors
In addition to providing transactional and litigation services for financially healthy business clients, Tabor Law Group assists businesses suffering financial distress, including:
- Advising the boards of directors of insolvent businesses regarding their fiduciary duties
- Assisting insolvent businesses with the documentation, negotiation, and implementation of non-bankruptcy alternatives, such as out-of-court workouts with creditors, liquidations, and assignments for the benefit of creditors
- Counseling the management team of insolvent businesses regarding bankruptcy options, and when reorganization is possible, guiding such "debtors in possession" through all aspects of chapter 11 filings, including filing of schedules, statements of financial affairs, and financial reports, obtaining approval of use of cash collateral and all other "first day" motions, litigation of claims, and the development and confirmation of plans of reorganization and approval of disclosure statements
- When reorganization is not feasible or desired, assisting businesses with documenting and obtaining approval of sales of substantially all assets in the chapter 11 context under Section 363 of the Bankruptcy Code
- Assisting insolvent business entities or their owners with all aspects of the chapter 7 bankruptcy liquidation process
